DigiRiskAsses is an AI-powered platform designed to assist in workplace safety risk assessments. The Service uses artificial intelligence to analyze user-submitted data, including text and images, to identify potential hazards and suggest mitigation strategies.

3. User Responsibilities

• You are responsible for the accuracy and legality of all data you upload to the Service.
• You agree not to upload any content that is unlawful, harmful, or violates the privacy of others.
• You are responsible for maintaining the confidentiality of your account credentials.
• The primary responsibility for ensuring workplace safety remains with you, the user. The Service is a supplementary tool and not a substitute for professional human judgment, on-site inspections, or adherence to legal safety standards (e.g., OSHA, HSE).

4. AI and Data Analysis

You acknowledge and agree that:

• The Service uses generative AI, which may produce inaccurate or incomplete information. Outputs from the AI (including hazard identification, risk levels, and recommendations) are for guidance only.
• You must independently verify all AI-generated outputs before taking any action.
• DigiRiskAsses is not liable for any errors, omissions, or inaccuracies in the AI-generated content.
• By uploading data, you grant DigiRiskAsses a worldwide, non-exclusive, royalty-free license to use, reproduce, and process this data for the purpose of providing and improving the Service.

5. Intellectual Property

All rights, title, and interest in and to the Service (excluding user-provided content) are and will remain the exclusive property of DigiRiskAsses and its licensors. The Service is protected by copyright, trademark, and other laws of both South Africa and foreign countries.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DIGIRISKASSES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (i) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (ii) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; (iii) ANY CONTENT OBTAINED FROM THE SERVICE; AND (iv) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK.

7. Governing Law

These Terms shall be governed and construed in accordance with the laws of the Republic of South Africa, without regard to its conflict of law provisions.

8. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of any changes by posting the new Terms on this page.
